These terms are an agreement between you and the developer of Zenbu ("we", "us"). They cover your use of the Zenbu iPhone app and its hosted service during the internal beta. Please read them before using Zenbu. By accepting these terms in the app, or by using Zenbu, you agree to them. If you do not agree, do not use Zenbu.
Zenbu's internal beta is limited to people we invite, and you must be at least 18 years old. It is not offered to the public and is not intended for children. Do not share beta builds, invite links or access with anyone else.
Zenbu is a personal fitness, nutrition and body-data tracking tool. It records what you choose to log and shows descriptive summaries of your own data.
Zenbu is not a medical device and does not provide medical, dietary, or professional advice. It is not intended to diagnose, treat, cure, or prevent any disease or condition. Calories, macronutrients, micronutrients, energy-expenditure estimates, weight trends, recovery and sleep summaries, and any other figure Zenbu displays are approximations derived from data you or third parties supply. Do not rely on Zenbu alone for decisions about your health, diet, training, supplements, or medication. Consult a qualified professional before making changes, and seek medical attention for any concerning symptom. Nothing in Zenbu creates a clinical relationship.
You understand that you are testing unfinished software and that it may be unstable. Features may change, break, or be removed, and the beta may end at any time. Data you enter may be lost, corrupted, or become unreadable as the app changes. Do not treat Zenbu as your only record of anything that matters: use the built-in export regularly and keep your own copies. We do not promise that the beta, or any particular feature, will ever be released.
Feedback, bug reports and suggestions you send may be used to improve Zenbu without compensation or attribution.
Zenbu combines data from sources we do not control. Generic and branded food information comes from the USDA FoodData Central and Open Food Facts; recovery, sleep and activity data may come from WHOOP; health data may come from Apple Health. Those services are governed by their own terms and privacy policies, and they may be unavailable, change, or be inaccurate. Food entries can be incomplete or wrong — always check the package label. We are not responsible for third-party data or services, and we do not guarantee that an integration will continue to work.
Your beta build is distributed through Apple's TestFlight, and Apple's terms also apply to that distribution.
Zenbu is provided "as is" and "as available", with all faults, and without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, or non-infringement. We do not warrant that Zenbu will be uninterrupted, secure, error-free, or free of harmful components, or that any data or calculation will be accurate or complete.
Changing what you eat and how you train carries inherent risk. You accept those risks, and you are responsible for the decisions you make about your own body. Zenbu is a logging and descriptive tool; it does not supervise you or evaluate your safety or suitability for any diet, exercise, or supplement.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost data, lost records, lost profits, or the cost of substitute services, arising out of or relating to Zenbu or these terms, however caused and regardless of the theory of liability.
To the maximum extent permitted by law, our total aggregate liability for all claims relating to Zenbu will not exceed the greater of the amount you paid us for Zenbu in the twelve months before the claim (which is zero during the beta) or fifty US dollars.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing here excludes or limits any liability that cannot lawfully be excluded or limited, including for gross negligence, willful misconduct, or fraud. Nothing in these terms limits your statutory consumer rights where they apply.
You may stop using Zenbu at any time, and you can delete your account in the app. We may suspend or end your access to the beta, or discontinue the beta, at any time and without notice. Sections 2, 5, 6, 7, 8, 10, and 11 survive termination.
We may update these terms as the beta develops. When we make a material change, the app will ask you to review and accept the new version before you continue. The version and date at the top of this page identify the current terms.
This agreement is between you and us only, not with Apple. Apple has no obligation to provide maintenance or support for Zenbu, and no warranty obligations for it. Apple is not responsible for addressing any claim you or a third party may have relating to Zenbu. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You must comply with applicable third-party terms when using Zenbu.
These terms are governed by the laws of the State of [STATE], United States, without regard to conflict-of-law rules, and the state and federal courts located there have jurisdiction, except where the law gives you the right to bring a claim elsewhere.
